These Terms and Conditions govern your use of our website and the purchase and use of our services, including online assessment quizzes, 1-to-1 coaching/consultation sessions, ongoing guidance and support packages, and digital learning resources (together the “Services”).

References in these Terms to “TheMentalFitnessDr.”, “we”, “us”, or “our” mean Ashton Shaw Specialist Psychology Services Ltd trading as TheMentalFitnessDr.

By accessing our website or purchasing any Service, you agree to be bound by these Terms and Conditions.

1. Definitions
- “We/Us/Our” means Ashton Shaw Specialist Psychology Services Ltd trading TheMentalFitnessDr.
- “You/Your” means the person or entity purchasing or using the Services.
- “Content” means all quizzes, videos, PDFs, worksheets, text, images, and other materials provided through the Services.
2. Services
2.1 We provide (under the trading name TheMentalFitnessDr.):
- Online assessments/quizzes (delivered digitally)
- 1-to-1 sessions via video call (Zoom, Google Meet or similar)
- Ongoing guidance and support packages (email, messaging, or scheduled calls)
- Downloadable and online learning resources
2.2 All Services are for personal, non-commercial use only unless we expressly agree otherwise in writing.
3. Ordering and Payment
3.1 Orders are accepted when we send you written confirmation and payment has been received in full (unless a payment plan has been expressly agreed).
3.2 Prices are shown in GBP and include VAT where applicable.
3.3 Payment is taken via Stripe, PayPal or other payment providers displayed at checkout. You are responsible for any transaction fees charged by your bank or card provider.
3.4 We reserve the right to change prices at any time. The price you pay is the price displayed at the time of purchase.
4. Access to Digital Content and Quizzes

4.1 Upon successful payment, you will be granted a non-transferable, non-exclusive licence to access the purchased digital Content for your personal use.
4.2 Access is provided via our website or third-party platforms (e.g., Scoreapp). You are responsible for maintaining the confidentiality of your login details.
4.3 You must not share, distribute, resell, or reproduce any Content.

5. 1-to-1 Sessions and Ongoing Support
​
5.1 Sessions are booked via our online booking system.
5.2 You must provide at least 48 hours’ notice to cancel or reschedule a session. Cancellations with less than 48 hours’ notice will be charged in full.
5.3 We reserve the right to reschedule sessions with reasonable notice.
5.4 Sessions are delivered remotely via video call. You are responsible for a stable internet connection and a quiet, private environment.
5.5 Sessions are not therapy, medical advice, or regulated professional services unless explicitly stated and delivered by a qualified and registered professional.

6. Refunds and Cancellation
​
6.1 Digital products (quizzes, downloadable resources, online courses, membership access):
Due to their instant-access nature, no refunds are offered after access has been granted, except where required by UK consumer law.

6.2 1-to-1 sessions:
​All 1-to-1 sessions are non-refundable once booked and paid for. However, you may reschedule your session free of charge provided you give us at least 48 hours’ notice before the original start time. Rescheduling requests made with less than 48 hours’ notice (or no-shows) will result in the session being forfeited with no refund or further rescheduling right.
6.3 Rescheduling procedure
Rescheduling must be requested by email to info@thementalfitnessdr.com or via the booking system (if available). We will offer you alternative times within the next 30 days (subject to availability). Only one free reschedule is permitted per booking.
6.4 Ongoing support/coaching packages that include 1-to-1 sessions
Sessions included in a package follow the same non-refundable policy above. Unused sessions do not carry a cash refund value.
6.5 Exceptional circumstances
At our sole discretion, we may offer a refund or credit note in genuine cases of serious illness, bereavement, or other extenuating circumstances (proof may be required).
6.6 Statutory rights Where you have a 14-day cooling-off right under the Consumer Contracts Regulations 2013, this right is lost as soon as the first 1-to-1 session takes place (or digital content is accessed) with your prior express consent and acknowledgement that you will lose the right to cancel.
7. Intellectual Property

All Content remains our property or the property of our licensors. You are granted a limited licence for personal use only. Unauthorised copying, sharing, or commercial exploitation is strictly prohibited and may result in legal action.

8. Limitation of Liability
​
8.1 Our Services are provided “as is” and we make no warranties about outcomes, results, or suitability for your particular circumstances.
8.2 To the fullest extent permitted by law, our total liability to you shall not exceed the amount you paid us in the 12 months preceding any claim.
8.3 We are not liable for indirect, consequential, or special losses.

9. Your Responsibilities

You agree:
- To provide accurate information when registering or booking
- Not to record sessions without prior written consent
- To use the Services lawfully and respectfully

10. Data Protection
​
We process personal data in accordance with our Privacy Policy (available on our website) and UK GDPR.

11. Complaints
​
If you have a complaint, please email us at info@thementalfitnessdr.com. We will acknowledge within 5 working days and aim to resolve within 28 days.

12. Governing Law and Jurisdiction
​
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

13. Changes to These Terms
​
We may update these Terms from time to time. The latest version will be posted on our website.
